Breath Test::
In the state of Ohio, it is against the law to drive with prohibited quantities of alcohol within your breath, blood, or urine - even if the actual alcohol is not necessarily impairing your capability to drive there is a different offense of operating a motor vehicle under the influence if your own ability to drive is impaired. In order to determine the actual amount of alcohol in your system, the police officer will request you to submit to a test of your breath, blood, or urine. Below is some information about these tests.
Breath Tests. The most popular test for alcohol concentration is actually the breath test. In the event that you consent to the test, you provide a sample of your breath by blowing into a machine most likely a Datamaster or possibly an Intoxilyzer. The machine transmits infrared energy through the holding chamber containing the breath sample. Alcohol compounds absorb infrared energy at certain frequencies, so the device measures the actual amount of infrared energy absorbed to identify how much alcohol is present in the breath sample. The machine converts the concentration in the breath sample to a result indicated in grams of alcohol per 210 ml of breath and creates a printout of the result. If the result is at or above .08 you are charged with DUI / OVI. If the result is at or above .17, you are charged with OVI "high test". If law enforcement agencies do not always maintain, fix, and use the breath testing device within compliance with state regulations, the actual results of the breath test may be inadmissible.
